These terms of use govern the use of the "Parkwärter" app (hereinafter "app") and the associated website (hereinafter collectively "service"). The service helps you remember to place a parking disc. It does not constitute legally binding information and does not replace your own verification of local parking regulations.

By using the service, you agree to these terms of use.

2. Description of the Service

Parkwärter automatically or upon triggering detects when you arrive at a location and checks a database to determine whether a parking disc is required there. Based on the result, a notification is sent to you.

The information provided is based on a regularly updated but not exhaustive database. No guarantee is made regarding the accuracy, completeness, or timeliness of the data.

3. Disclaimer of Liability

The operator assumes no liability for:

• Incorrect, incomplete, or outdated parking disc requirement determinations
• Missing, delayed, or erroneous notifications
• Outages, interruptions, or malfunctions of the service
• Fines, warnings, or other consequences resulting from the use or non-use of the service

You remain solely responsible at all times for complying with the parking rules and regulations applicable at your location.

4. Availability

The operator strives to provide the service without interruptions. However, no guarantee is given for any specific availability or uptime level. Maintenance work, technical issues, or force majeure may lead to temporary limitations.

The operator reserves the right to modify, restrict, or discontinue the service at any time.

5. Your Obligations

For the service to function properly, you must grant the permissions requested by the app. Depending on the selected detection mode, these include in particular:

• Access to your location (always or while using the app)
• Permission to send notifications
• Access to motion data (in automatic mode)

If required permissions are not granted, the functionality of the service may be limited or unavailable entirely. You agree not to misuse the service.

6. Paid Features

The service offers a subscription for full functionality. All payments are processed through Apple (App Store). The operator reserves the right to introduce additional paid features or premium offerings. You will be informed of any changes in a timely and transparent manner.

7. Intellectual Property

All content of the service -- including text, graphics, logos, app design, source code, and database contents -- is protected by copyright and is the property of the operator or its licensors. Any reproduction, distribution, modification, or other use beyond the limits of copyright law requires the prior written consent of the operator.

8. Changes to These Terms

The operator reserves the right to modify these terms of use at any time. Changes will be announced through the app or the website. By continuing to use the service after changes are announced, you agree to the updated terms.

9. Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
